Terms of Service

The agreement, in plain language.

These terms govern your use of the service. We have written them to be readable, not to bury anything. They sit alongside our privacy policy, which covers how we handle your DNA and personal data.

Draft — pending counsel review

This Terms of Service is a working draft and is not yet finalized legal advice. The binding language — including liability limits, dispute resolution, and the governing-law jurisdiction — is being reviewed by counsel and may change before it takes effect. If anything here conflicts with applicable law, the law controls. Questions? Use the contact route in section 10.

Terms of Service

Last updated: June 2026 · Operated by The Jewish Family

1. Acceptance of these terms

By creating an account, uploading data, or otherwise using the service operated by The Jewish Family (“we,” “us,” the “service”), you agree to these terms and to our privacy policy. If you do not agree, do not use the service. You must be an adult to use the service (see our privacy policy on children).

2. The service

The service builds a cited family-history narrative from data you choose to upload — your DNA file or GEDCOM tree — together with historical and ancient-DNA records, and presents it with a citation back to every source. We may add, change, or discontinue features over time. We do not guarantee that any particular record, match, or connection will be found; the narrative reflects the evidence available, and “no data yet” is an honest result, not a failure.

3. Your DNA and genetic data

Your raw DNA file and genotype data are personal to you. We process them solely to build your narrative and to match you against historical and ancient-DNA records, as described in our privacy policy. We do not sell your DNA data, do not use it to train AI models, and do not share it with advertisers.

Genetic data is a special category of personal data (for example, under Article 9 of the GDPR for users in the EU/UK). We process it on the basis of your explicit consent, which you give when you upload, and which you can withdraw at any time by deleting your data — see the deletion section of our privacy policy. You confirm that you have the right to upload any DNA or tree data you provide, and that you are not uploading the genetic data of another living person without their consent.

4. Subscriptions and billing

The service is free to start. Paid plans (“Pro”) unlock additional features and are billed through our payment processor on a recurring basis until you cancel. Prices, plan contents, and billing cadence are shown at the point of purchase and on our pricing page. You can cancel a recurring plan at any time from your account; cancellation stops future renewals. Refund eligibility and any statutory withdrawal rights are governed by applicable consumer law and the terms presented at purchase. [DRAFT — counsel to confirm refund and renewal terms.]

5. Acceptable use

You agree not to:

  • upload data you do not have the right to upload, or another living person’s genetic data without their consent;
  • attempt to access another user’s account, data, or tenant;
  • scrape, bulk-download, resell, or redistribute the service or its records in violation of the source archives’ terms;
  • reverse engineer, disrupt, or attack the service or its infrastructure;
  • use the service for any unlawful purpose, or to harass or harm others.

We may suspend or terminate an account that violates these rules, with notice where practicable.

6. Intellectual property

The service, its software, design, and original narrative text are owned by The Jewish Family or its licensors. Your uploaded data remains yours. Historical and archival records cited in your narrative are public records held by their source archives; we present them with attribution and do not claim ownership of them. We grant you a personal, non-transferable right to use the service and to view, export, and share your own narrative for personal, non-commercial purposes.

7. Disclaimers and limitation of liability

The service is provided “as is.” Genealogical and ancient-DNA inferences are probabilistic; a cited record is evidence, not a legal proof of relationship or identity. To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these terms limits any liability that cannot be limited under applicable law (including, for consumers, their statutory rights). [DRAFT — counsel to set the liability cap and carve-outs.]

8. Changes to these terms

We may update these terms from time to time. If we make a material change, we will update the date above and, where appropriate, notify you. Your continued use of the service after a change takes effect means you accept the updated terms.

9. Governing law

These terms are governed by the laws of the jurisdiction in which The Jewish Family is established, without prejudice to any mandatory consumer-protection rights you have in your country of residence. [DRAFT — counsel to specify the governing jurisdiction and venue.]

10. Contact
